En la actualidad continua funcionando el seguro social, a través del Instituto Venezolano de los Seguros Sociales (IVSS), al cual en principio, no podrían afiliarse los miembros de cooperativas. En la presente investigación documental se analizan las normas que regulan el Sistema de Seguridad Social, particularmente las que rigen el nuevo Sistema de Seguridad Social, todas ellas vigentes desde su publicación aunque algunas inaplicadas e inaplicables por su complejidad, por lo costoso que resultaría para los participantes en dicho Sistema y por la falta de voluntad política, entre otras razones. Asimismo, se mencionan los Fondos de Protección Social que las cooperativas deben crear para atender las situaciones especiales de los trabajadores asociados, los cuales la mayoría de las veces no se establecen por el desconocimiento de los interesados o sencillamente por la carencia de los recursos necesarios. Se concluye que aunque tales Fondos poseen carácter complementario a la protección que debe brindar el Sistema de Seguridad Social, en la práctica, cuando existen, constituyen casi el único mecanismo de protección social con que cuentan los socios de las cooperativas.<hr/>Despite the multiplicity of legal instruments existing in the Social Security area in Venezuela, workers associated in cooperatives do not have the protection the Social Security System offers; this is due, first to the fact that the system is unfinished, key laws have not been issued nor have the institutions been created that ought to make it operational. Currently, social security is functioning through the Venezuelan Institute of Social Securities (IVSS), with which members of cooperatives cannot affiliate on principle. This documentary investigation analyzes the norms that regulate the Social Security System, particularly those governing the new Social Security System, all of which have been in effect since their publication, although some are not applied or not applicable due to their complexity, the cost they would engender for participants in the aforesaid system and due to a lack of public will, among other reasons. Likewise, the study mentions the Social Protection Funds that cooperatives should create to take care of special situations for the associated workers; most of the time, these funds are not established due to lack of knowledge by the interested parties or simply due to a lack of the necessary resources. Conclusions are that although such funds have a complementary character to the protection the Social Security System should provide, in practice, when they exist, they are almost the only social protection mechanism that cooperative partners enjoy. <![CDATA[<b>Regarding the So-called Crisis of the Traditional Labour Contract and the Spanish Contribution</b>: <b>The Statute of Self-Employment</b>]]> http://ve.scielo.org/scielo.php?script=sci_arttext&pid=S1315-85972008000200002&lng=en&nrm=iso&tlng=en El trabajo estudia las razones y las características del proceso de evolución que caracteriza tanto el mundo del trabajo como la propia regulación jurídica del trabajo asalariado y que ha dado lugar a que se hable en todos los ordenamientos jurídicos europeos de crisis del contrato de trabajo. Al mismo tiempo, se estudia el Estatuto del Trabajo Autónomo, recién promulgado en España, como una aportación a los debates doctrinales al respecto.<hr/>This work studies the reasons and features of the evolution process characterizing the world of labour as well as the legal regulation of unsalaried labour and which has produced the result that all European legal ordinances speak about the labour contract crisis. At the same time, the Statute of Self Employment (Autonomous Labour), recently promulgated in Spain, is studied as a contribution to doctrinal debates on the subject. <![CDATA[<b>Economic and Political Strategies of Large Private Venezuelan Food Companies and Their Effects on Workers, Consumers and Small Businesses</b>]]> http://ve.scielo.org/scielo.php?script=sci_arttext&pid=S1315-85972008000200003&lng=en&nrm=iso&tlng=en A partir de un estudio teórico-práctico, con base en análisis de documentos, entrevistas y observación directa, se exploran las estrategias económicas y políticas de grandes empresas alimenticias en Venezuela: estrategias de colaboración horizontal para concentrar capital, controlar el mercado y reducir costos laborales; estrategias de cooperación jerárquica, que flexibilizan las relaciones laborales mediante sistemas de subcontratación; estrategias agresivas contra otras empresas, que eventualmente eliminan oportunidades de empleo; estrategias tecnológico-organizativas, para masificar la producción, reducir costos laborales y asegurar el control sobre los trabajadores; el lockout o paro patronal como estrategia de lucha política, destinada a cambiar la orientación del gobierno bolivariano, cuyas consecuencias fueron eliminación de fuentes de empleo, reducción drástica de productos de consumo masivo y quiebra de pequeños empresarios; y finalmente el proceso de construcción de nuevas relaciones de las empresas con el Estado, lo cual facilita la generación de nuevas fuentes de trabajo. Se concluye que las estrategias empresariales expresan los fines de control y poder de grandes grupos económicos sobre empresas pequeñas, consumidores y trabajadores y la tensión entre los intereses económicos a corto plazo y los intereses políticos a lago plazo.<hr/>Starting from a theoretical-practical study based on an analysis of documents, interviews and direct observation, the economic and political strategies of large food companies in Venezuela are explored: horizontal collaboration strategies to concentrate capital, control the market and reduce labor costs; hierarchical cooperation strategies the flexibilize labor relations through subcontracting systems; aggressive strategies against other companies, which eventually eliminate employment opportunities; technological-organizational strategies to achieve mass production, reduce labor costs and assure control of the workers; the lockout or employer’s strike as a strategy of political struggle, destined to change the orientation of the Bolivarian government, whose consequences were the elimination of employment sources, drastic reduction of mass consumption products and the bankruptcy of small businesses; and finally, the process of constructing new relationships between the companies and the State, which facilitates generation of new employment sources. Conclusions are that the business strategies express goals of control and power for the large economic groups over small businesses, consumers and workers and the tension between short-term economic interests and long-term political interests. <![CDATA[<b>The Beginnings of Social Reformism in Spain</b>: <b>the First Social Legislation and the Social Reforms Commission</b>]]> http://ve.scielo.org/scielo.php?script=sci_arttext&pid=S1315-85972008000200004&lng=en&nrm=iso&tlng=en El artículo ahonda en los inicios del reformismo social en España desde una doble perspectiva: la vertiente normativa y la científica. En este sentido, partiendo tanto de la doctrina actual, como de los tratadistas y documentación de la época, se analiza la primera legislación social y el intervencionismo científico en las relaciones productivas, llevado a cabo por la Comisión de Reformas Sociales. La concurrencia de ambos factores, el legislativo y el científico, fueron elementos imprescindibles en el surgimiento y posterior configuración del Derecho de Trabajo en España, imbricando en buena medida las instituciones nucleares de nuestro ordenamiento jurídico- laboral.<hr/>The article studies in depth the beginnings of social reform in Spain from a double perspective: the legal aspect and the scientific aspect. Starting from current doctrine as well as writers and documents of that time, this article analyzes the first social legislation and scientific interventionism in the productive relations carried out by the Social Reforms Commission. The combination of both legislative and scientific factors was an essential element in the emergence and later configuration of Spanish Labour Law, interweaving to a great extent the nuclear institutions of our legal labour code. <![CDATA[<b>A Study of the Staff Recruiting and Selection Process in the Puerto Montt Commune, Lake Region, Chile</b>]]> http://ve.scielo.org/scielo.php?script=sci_arttext&pid=S1315-85972008000200005&lng=en&nrm=iso&tlng=en Esta investigación intenta explorar los elementos necesarios para el conocimiento acerca de cómo las organizaciones de la comuna de Puerto Montt, ubicada en la Región de Los Lagos de Chile, realizan el proceso de reclutamiento y selección de personal. Para ello, se abordan los principales fundamentos teóricos y prácticos vinculados al tema. Así mismo, se presentan y analizan los resultados de una encuesta aplicada a las organizaciones de la comuna de Puerto Montt con el propósito de indagar cómo éstas realizan el proceso de obtención de personal, la importancia que tiene para las organizaciones este proceso, los aspectos más importantes que consideran al momento de seleccionar a un candidato, las ventajas de aplicar una técnica y no otras, los métodos más utilizadas y una serie de datos que aportan de manera significativa al estudio.<hr/>This study attempts to explore the elements needed to know how organizations in the commune of Puerto Montt , Chile, carry out the process of recruiting and selecting staff. The study addresses the major theoretical and practical bases related to the theme; likewise, it presents and analyzes the results of a survey applied to organizations in the Puerto Montt commune, to find out how they carry out the process of obtaining staff, the importance that this process has for the organizations, the most important aspects they consider when selecting a candidate, the advantages of applying one technique over others, the most-used methods and a series of other data that contribute significantly to the study. <![CDATA[<b>Tendencias actuales de la Seguridad Social en Brasil</b>]]> http://ve.scielo.org/scielo.php?script=sci_arttext&pid=S1315-85972008000200006&lng=en&nrm=iso&tlng=en Esta investigación intenta explorar los elementos necesarios para el conocimiento acerca de cómo las organizaciones de la comuna de Puerto Montt, ubicada en la Región de Los Lagos de Chile, realizan el proceso de reclutamiento y selección de personal.
