Derechos humanos: ¿una “esencia oculta”? http://ve.scielo.org/scielo.php?script=sci_arttext&pid=S1315-62682006000300003&lng=es&nrm=iso&tlng=es The new approach of analytical jurisprudence was in line with the tradition of Scandinavian realism. My contribution addresses the search for differences and similarities by describing the contribution of Scandinavian authors on legal rights and more explicitly their ontological and semantic nature, the issues of a definition and its practical utility within the legal system. The debate on legal rights arose in the 40’s may be considered as still actual in the sense that the semantic and pragmatic approach has nowadays involved the issues concerning the nature of human rights. It is recognizable in the debate on human rights a pragmatic approach on the subject seem to predominate. Pragmatic and realistic instances get the upper hand. The definition of a theoretical concept (as “human right” or “legal right”) does not say anything concerning the content and moreover the forms of protection or the immunities which should be stated as fundamental. Scandinavians seem to avoid ontological-substantial definitions.
Common law indigenous rights, known in other legal jurisdictions as Indigenous Rights or natural rights, constitute a specific manifestation of the political and social autonomy claimed by indigenous populations in certain countries in Latin America, for the purpose of resolving conflicts between the same according to their customs and traditions. In a review of constitutional and normative advances in this area, one observes the impact that the ratification of this agreement (Covenant 169 of the International Labor Organization, OIT) will have in the internal legal process in each nation, and it is seen to be an element that touches upon the malfunctions of states rights, and strengthens the participation of indigenous actors in democratic systems.
The objective of this paper is to point out the homologous points and the ruptures found in the Argentine case, between populist discourse and so-called “Latin American” Philosophy. The purpose is to contribute to political and theoretical clarity in relation to phenomenon which within diverse practical fields (what is directly political and what is philosophical production) have played import roles in antagonistic moments of social confrontations: phenomenon which until now have been insufficiently analyzed both separately and in relation to possible mutual articulations.
This research analyzes the right to education as a fundamental right within the conception of a social state of rights and justice, found in the text of the 1999 Constitutional, and the process of which, together with the right to work, becomes the fundamental axis for the development of the objectives of the State, and a determinant factor in defining and developing the social-economic model present in the Constitution. Also, we analyze the economic rights guaranteed in the promulgation of the Constitutional Charter, with a brief reference to the 1961 Constitution, in order to finish the analysis of the social economic model and its intimate relation with the 1999 educational model. In particular, the educational “Vuelvan Caras” (About face) program, and Endogenous Development missions for the construction of a social productive model, are analyzed. As a conclusion, we feel that the right to education, as conceived in the 1999 Constitution, is not only a fundamental rights to achieve the ends of the State, but constitutes a determining process in the distribution of the wealth of the country and in priority investment in the same.
