The Soft Law and its Application to the Universal Declaration of Human Rights and the American Declaration of the Rights and Duties of Man

El objetivo de esta investigación es analizar la técnica legislativa del Soft Law aplicada en la Declaración Universal de los Derechos Humanos y en la Declaración Americana de los Derechos y Deberes del Hombre. La investigación es descriptiva y se utiliza la técnica de la observación documental. Se concluye que el Soft Law constituye una técnica legislativa que ha permitido la creación de directrices no vinculantes a seguir por los Estados en la regulación de los derechos humanos a los fines de facilitar la suscripción de tratados internacionales para resguardar derechos inherentes al individuo.

The objective of this investigation is to analyze the legislative technique of the Soft Law applied to the Universal Declaration of Human Rights and the American Declaration of the Rights and Duties of Man. The research is descriptive and uses documentary observation. Conclusions were that the Soft Law constitutes a legislative technique that has permitted the creation of non-binding directives to be followed by the States in the regulation of human rights aiming to facilitate subscription to international treaties that protect inherent individual rights.

Social Representation of Mission Sucre in the Framework of the Social Balance Plan in Venezuela

El objetivo de esta investigación consistió en describir la Misión Sucre como Programa alternativo de la Educación Superior, su alcance e impacto social desde la perspectiva axiológica y praxiológica del Plan de Equilibrio Social 2001-2007. Se parte del enfoque sociojurídico y de la racionalidad política que subyace en este objeto de estudio. Desde la perspectiva axiológica, la Misión Sucre pretende introducir una visión humanista a la educación Superior con el objeto de fortalecer la participación comunitaria, rompiendo con la política educativa tradicional de la discriminación en el proceso de selección, garantizando el acceso a la educación universitaria a todos los bachilleres sin cupo con la finalidad de convertir el subsistema de educación superior en un ente que intenta repotenciar la sinergia institucional. La investigación se suscribe en la metodología cualitativa de las representaciones sociales partiendo de la información documental, hasta la recolección de información de entrevistas a expertos que opinaron sobre el objeto de estudio. Los resultados de esta investigación proporcionaron elementos significativos de elementos axiológicos y praxiológicos que fundamentaron las nociones del Plan de Equilibro Social y la Misión Sucre de forma sistemática y organizada desde una perspectiva holística.

The objective of this investigation was to describe Mission Sucre as an alternative higher education program and study its scope and social impact from the axiological and praxeological perspective of the Social Balance Plan 2001-2007. The study is based on a socio-juridical and political rationality approach that underlies its purpose. From the axiological perspective, Mission Sucre seeks to introduce a humanist vision into higher education in order to strengthen community participation; it breaks with the traditional educational policy of discriminating in the selection process, thereby guaranteeing access to university education for every high school graduate without a place in another institution, in order to transform the higher education subsystem into an entity trying to re-potentiate institutional synergy. The investigation follows the qualitative methodology of social representations starting with documentary information, including information gathered from interviews with experts who gave opinions on the case under study. The results of this investigation provided significant axiological and praxeological elements to support the ideas in the Plan for Social Balance and Mission Sucre in a systematic and organized way from a holistic perspective.

Venezuelan Democracy Seen from the Triangular Relationship: Force, Power and Right

El Estado moderno tiene como sustento la relación triangular existente entre fuerza, poder y derecho. Se entiende que el sano equilibrio de estos tres elementos produce la estabilidad democrática, en virtud de la fuente legitimadora del Estado para aplicar sus normas, y su poder de coerción sobre los ciudadanos. En el proceso de transformación del poder en derecho y del derecho como respaldo de la fuerza interviene una lógica jurídica la cual obedece específicamente a mecanismos de Procesos Constitucionales de creación normativa. En el periodo de consolidación de la democracia venezolana desde el 23 de enero de 1958, y el proceso de cambio radical de 1999, intervinieron los elementos antes nombrados, por lo cual el siguiente papel de trabajo pretende la descripción de los mismos y el rol que jugaron en desarrollo de la democracia venezolana, durante su consolidación, mantenimiento, y cambio.

The modern State uses the triangular relationship of force, power and right as its support. It is understood that a healthy balance of these three elements produces democratic stability by virtue of the legitimating source of the State to apply its laws, and its coercive power over the citizens. In the power transformation process in law and of law as a backup for force, a juridical logic intervenes that specifically obeys Constitutional process mechanisms for creating laws. In the consolidation period of Venezuelan democracy, starting on January 23, 1958, and in the radical change process of 1999, the aforementioned elements intervened; therefore, the following work paper intends to describe them and the role they played in the development of Venezuelan democracy during its consolidation, maintenance and change.

India: Birth of a Modern Power

Cuando se habla del actual desarrollo económico y social de Oriente, no se puede dejar de mencionar y analizar un país como la India, el cual, junto a la China, representan las nuevas naciones que participan a plenitud en el nuevo escenario internacional, influenciándolo económicamente y políticamente. Muchas veces India ha sido vista y descrita de manera muy sumaria y estereotipada: antiguos templos, el país de las castas sociales, de muchas divinidades, de grandes diferencias sociales, de la vaca sagrada, del yoga y del misticismo, de poca higiene, entre otros aspectos, olvidando su aporte a la historia humana universal, pasada y presente. A partir de un recorrido histórico-sociológico y una metodología basada sobre datos económicos reales sobre este país, se pretende explicar algunos factores que han incidido en el paso de una sociedad predominantemente agrícola y subdesarrollada, muy dividida socialmente, hacia una sociedad moderna constituida en potencia económica mundial y organizada post-colonialmente sobre fundamentos igualitarios y democráticos.

When the present economic and social development of the East is mentioned, it is impossible to avoid mention and analysis of a country like India, which next to China, represents the new nations that participate fully on the new international scene, influencing it economically and politically. Often, India has been seen and described in a very summary and stereotyped way as a country of old temples, social castes, many divinities, great social differences, the sacred cow, yoga and mysticism and little hygiene, among other aspects, forgetting its contribution to universal human history, past and present. Starting from a historical-sociological review and using a methodology based on real economic data about this country, the present work tries to explain some factors that have affected the passage of a predominantly agricultural, underdeveloped and very socially divided society toward a modern society transformed into a world economic power and organized post-colonially on egalitarian and democratic foundations.

Internet, the Icon of Post-modernism

Con este trabajo se trata de demostrar cómo el Internet se ha convertido en un símbolo representativo de lo que se ha dado en llamar el Postmodernismo; se pretende discutir las características mas resaltantes que expresa el Internet bajo la óptica de lo que se entiende como postmodernismo. A través de una revisión bibliográfica se presentan las diferentes definiciones y conceptualizaciones del modernismo y el postmodernismo y de cómo se identifica el Internet como un icono de éste último. Se hace una revisión exhaustiva de diversos autores y se comparan las diferentes visiones y particularidades que identifican al modernismo y al postmodernismo. Por un muestreo a un grupo de internautas se establece la percepción de las particularidades que identifican al postmodernismo con el Internet. Igualmente se analiza el Internet caracterizado desde una perspectiva conceptual. Basado en las consideraciones teóricas y analizando la percepción del grupo de internautas acerca del Internet y sus características. Se concluye que el Internet se ubica dentro de la condición posmodernista y se abre la posibilidad de que sea uno de sus iconos más significativos y por ende contribuye al avance que esa condición posmodernista ha tenido en los múltiples aspectos de la realidad histórica.

In this paper we intend to demonstrate that Internet has become a representative symbol of Postmodernism, and we attempt a discussion of the relevant characteristics that Internet expresses under the optics of that which is understood as postmodernism. Through a bibliographical review of different definitions and conceptualizations from modernism, the manner in which Internet is identified as an icon of the postmodernism condition is studied. An exhaustive review of diverse authors and different visions and characteristics that identify modernism and postmodernism are compared. By sampling a group of internet users, the perception of the characteristics determine that they identify postmodernism with Internet. Also, Internet is characterized and analyzed from a conceptual perspective. After analyzing the perception of the group of Internet users about Internet and its characteristics, it is concluded that internet is located within postmodernism and it is possible that internet becomes one of the most significant icons of the postmodernist condition and therefore contributing to the advance that postmodernist condition has had in the multiple aspects of historical reality.
