Establishment of the right to supranational collective negotiation has some lacunas that make it difficult to sustain its real existence in the present day. This work analyzes the rights principle characteristics in the light of the consolidated version of the Constitutional Treaty of the European Union and the project for the European Constitution, which has not yet been ratified by all member-States. The right to collective negotiation is a fundamental human right that ought to be promoted by the Union and is a privileged tool for harmonizing systems of labor relations and above all, for advancing consolidation of the European social model.
