Summary The intellectual protection systems related to living matter have suffered important changes as a result of the fundamental scientific and technological advances of the last decades and in response to international trade negotiations. Mexico has not remained foreign to these changes, and presently the country has a legal system which establishes the guidelines for patenting biological processes and materials, animal stock, plant varieties and parts of the human body, as well as for the protection, trade and promotion of seed and vegetative material innovation. Within the framework of this legal system, a large number of patents related to biotechnology have already been granted, and many others have been requested. There is a clear tendency to diversification of patenting areas, as well as an increase in the number of registers per year. However, there still exist many factors that limit innovation diffusion, which makes it necessary for countries such as Mexico to promote intellectual property management models that foster new developments and their diffusion.
