The fundamental objective of this article is to study the figure of penal mediation, framed within restitutive justice, which implies a paradigm change in the face of the traditional retributive justice approach, which is in crisis, given that the administration of justice, a responsibility of the State, is categorized in a complex, severe, strict order and determination of the existence of crimes, in the penal process, is based on rigid formulas that bring the judge to prove the accusation presented against the accused, without a significant valuation of the role of the victim, producing, thus, a double victimization. Penal mediation is an alternative, wherein the victim confronts the victimizer in search for consensual truth with the possibility of reconciliation between victim and author, thereby contributing to social pacification.
