Abstract

JIMENEZ CANO, Roberto M. Normativity in the Practical Theory of Rules. Frónesis [online]. 2009, vol.16, n.1, pp.109-124. ISSN 1315-6268.

This study attempts to respond to the normative character of social rules through the well-known practical theory of rules by Herbert Hart. Since this theory has experienced variations throughout the academic life of the aforementioned author, the study will not only acknowledge the original 1961 explanation, but all of its developments during the following thirty years. This review implies not only confronting Hart’s explanations, but also the criticism poured out on them, the interpretations, objections and consequences that his original ideas as well as its revisions have had.
