The present article explores the use of violence by the State as part of the replications and reorganizations of the political power in Latin America. It is argue that the State world reorganization tends to "normalize" and extend the State of Exception, features that were implemented previously in Latin-American countries history. In the 70, it was expressed through military coups, dictatorships and fraudulent governments; currently, without resigning completely these assets, it operates principally by the "deaf mechanisms of radical exclusion implying similar violent methods. Thus, it is proposed to establish a debate on legitimacy, that is, the actual participative bases of democracy, confronting the legalistic but exclusive government discourse that however violated constantly the owned right of disagreement of the excluded ones.
