Abstract This paper presents a general theoretical vision of the definitive aspects of the right to collective bargaining in Venezuela, as well as the meaning of three-party social dialogue, in order to inter-relate them and determine how they affect these rights, as one of the essential contents of labour union liberty. This leads without doubt to a violation of this fundamental human right. Also, the possible institutionalization of social dialogue as it has developed in Venezuela is analyzed, based on the respect for social arbiters to negotiate collectively, and in consequence the respect for the right to form labour unions. The conclusion is that instead of the evolution of the right to collective labour unions, this right has digressed.
