Abstract

Employee participation in the managements of companies in Venezuela is analyzed from several aspects: including political, jus-philosophical and constitutional, through a brief description of how the facts related to these phenomenon are occurring in the country, for the purpose of finding its basis: the possible justification for the participation of workers in economic aspects of business, the foundation of the political philosophy which is the base of this phenomenon (Marxist theory) and the arguments that explain it, the juridic theory that is developing, and the constitutional aspects that define the juridic regulation of this subject, and which deepen the social rights and possible damage to economic rights. The conclusions are: 1) the pertinence of the democratization of power in companies and in consequence the justification and utility of employee participation in these entities, since they make possible and contribute to deepening social rights. 2) The rejection of worker co-participation based presented in Marxist thought, since it goes against economic rights and is contrary to the principles of economical freedom established in the Venezuelan constitution. 3) The facts related to employees participation in companies in Venezuela are regulated informally which is reflected in a crisis in the traditional juridical forms, and could arbitrarily harm constitutional rights, such as economic and worker social rights.
