The information society has caused rigid, twentieth century labour relations to become flexible, adopt different shades and consequently extend their arms into places heretofore unimagined. Teleworking is a product of this flexibility and constitutes a work mode that, by virtue of its great economic, social and ecological benefits, is being adopted day to day by businessmen and workers around the world. Social realities are the motor of the juridical relations that as such must be regulated by law. As a social reality, teleworking deserves that law pay attention to, regulate and institutionalize it, as has already begun to happen in the European Union. Academic sectors in diverse countries should be linked to this regulatory work, because teleworking is still a figure under construction that merits everyones contribution. The objective of this paper is to determine whether teleworking configures a real labour relationship when examined through the magnifying glass of Colombian labour law; therefore, it was necessary to investigate its role within labour institutions and the developments it has undergone. At the end, we were able to answer the proposed question, because once the elements of the contract have been analyzed, teleworking can be framed within labour law and deserves to be regulated by it.
