Moral harassment in the workplace is a new phenomenon that became popular in the last decade of the last century. The legislator has still not provided a specific regulation for this behaviour, which does not indicate the existence of a legal hole, but is rather a deficiency of technical character in the formulation of certain norms or the presence of a legislative blank. What it has done without a doubt is to force the jurist to enliven his acuity while reviewing the concepts already designed by the legal code in order to solve this new labour problem. This scientific work seeks to offer diverse alternatives to resolve this situation in the light of existing law, to prevent and sanction labour harassment behaviours and to protect and compensate the worker who is a victim of this situation.
