The principal objective of this study is to analyze fundamental labor rights, in the general and Venezuelan spheres. To accomplish this, a relation is formulated between the state of right, democracy and fundamental rights; it is based on decent work as a guarantee of fundamental labor rights, and in terms of its implication in Venezuela, it identifies the corresponding normative instruments, the protection guarantees derived from such instruments; finally, an analysis is made about the dispositions and normative content regarding each one of the rights under studied, to wit: labor union freedom and collective bargaining, the elimination of forced labor, effective abolition of child labor and the elimination of discrimination in jobs and occupations. The conclusion indicates that in general, fundamental labor rights in Venezuela have a normative guarantee, but reality indicates the need to implement mechanisms oriented to their efficient and effective fulfillment. The study is documentary, supported by the analytical method.
