Abstract
MENDOZA-TELLO, Zulema; ROJAS-LUJAN, Víctor William and TELLO-YANCE, Filoter. Prosecutorial referral and full reparation of the aggrieved under restorative justice. Systematic review. Cienciamatria [online]. 2024, vol.10, n.18, pp.89-102. Epub Aug 22, 2024. ISSN 2610-802X. https://doi.org/10.35381/cm.v10i18.1235.
For many years in Peru, a retributionist model of justice was imposed, based only on the application of sanctions; on the other hand, fiscal remission emerged as a form of de-judicialisation of the process; these concepts were born as alternatives to traditional punitive measures, seeking a more satisfactory solution for both victims and offenders. The documentary review research consisted of analysing the fiscal remission and the integral reparation of the aggrieved in accordance with restorative justice. It was developed from the descriptive method of the quantitative paradigm and was complemented with a documentary-bibliographic design. It was approached from the analytical method, oriented and explored in the analysis of written content. It is conclusive to indicate that restorative justice in Peru is aimed at developing comprehensive responses to the offence, focusing on repairing the harm rather than focusing on punishment, promoting participation.
