This article emphasizes the importance of analyzing new trends on criminal policy, addressing the perspectives and challenges present in the Ecuadorian legal system for the protection of citizen rights. Through a qualitative methodology, from a critical approach, under the documentary and descriptive modality, it was possible to establish that despite the changes and transformations that the Ecuadorian State has promoted to consolidate an effective criminal policy, the reality studied shows a crisis. which continues to affect the majority of Ecuadorian citizens. Therefore, the State must strengthen its legal structure and create procedural norms that regulate police behavior, judicial agencies and the institutional penitentiary system, all with the aim of preventing, prosecuting and punishing the perpetrators responsible for the crime, respecting the constitutional guarantees of the entire population and assuming a restorative approach.
