The general objective of the research was to analyze artificial intelligence, judicial evidence and its impact on the right of defense in Peru. The methodology was based on research, collection and documentary analysis, supported by a methodical exploration of various sources, including peer-reviewed articles and institutional documents, which allowed the identification and description of the findings obtained. As a central instrument, primary sources (legal norms, jurisprudence and judicial doctrine) and secondary sources (doctrinal articles and comparative studies) were included. The inductive-deductive method was also used. In conclusion, generative intelligence involves risks in the evidentiary field. Generative artificial intelligence is expanding around the world, making it easier for any user to create synthetic evidence (false images, videos or audios). Although novel in popular use, this represents a serious risk for trials because it makes it difficult to verify immediately and undermines confidence in the evidentiary system.
