The objective of the research was to legally analyze the 5G network and its impact on legal sciences from a criminal perspective. The research was developed from the quantitative paradigm, and it was also framed from a documentary-bibliographic design. Many of the objects with which legal science works can be approached from a theoretical, empirical and quantitative dimension. For this purpose, Ecuadorian legislation and national doctrine were examined from various perspectives, making use of scientific articles and theses, digital repositories, with the use of methodological instruments such as the documentary record. It is concluded that, the institutional policies to be considered before the full implementation of the 5G Network, part of the evaluation made by the Legislature including the Judiciary Council before the latent, imminent, real and determined risks of technical character linked to the criminal conduct.
