Abstract

The general objective of the research was to legally analyze the application of the administrative disciplinary procedure and the violation of the right to due process. The method used in the research was based on the qualitative approach. The research technique applied was the interview; the tool or instrument used was the interview guide, which was applied to eight experts who handle cases of administrative proceedings against UGEL directors in the Amazon Region. The analysis of the interviews was carried out using ATLAS.ti software, which allowed grouping by categories. It is concluded that, in the application of administrative processes, a norm is not being respected that establishes that the offenses are only applicable to classroom functions and do not include administrative tasks or functions of the UGEL directors. This generates a lack of legal certainty.
