The general objective of the research was the legal analysis of the notarial authorization for the legitimate disposition of assets of minors and incapable persons. The method used in the research was based on the qualitative approach, handling the collection and analysis of a documentary-bibliographic typology. The research technique applied was the interview; the tool or instrument that supported it was the interview guide, which was composed of a multiplicity of questions formulated in relation to the study problem. It is concluded that the effective jurisdictional protection and the principle of the best interest of the minor require public officials and servants to ensure the protection of the minor's development, as well as the satisfaction of his or her basic needs. In this sense, when a minor is in a state of orphanhood, he/she can carry out acts of patrimonial disposition with the sole purpose of paying necessary expenses.
