Abstract

The general objective of the research was the legal analysis of the immediate reformed criminal process and the affectation of the right of defense in flagrante delicto. The method used in the research was based on a qualitative approach. Supported by a documentary typology. The inquiry technique applied was the interview; the tool or instrument that supported it was the interview guide. It was applied to the lawyers who handled the cases of the immediate reformed criminal process and in person, respecting the right to confidentiality; it should be noted that the interviewees were prosecutors, judges and lawyers. The analysis of the interviews was carried out using ATLAS.ti software. It is concluded that flagrancy is crucial because it allows for a quick and efficient judicial response to obvious crimes, which speeds up the judicial process and contributes to the effectiveness of the justice system by ensuring that crimes are punished in a timely manner.
