ROMERO-GRAUS, Carlos Hernán y VARGAS-FLORES, Rosa Luz. Professional liability and its regulation in the Peruvian legal context: Divergences and perspectives. Iustitia Socialis [online]. 2024, vol.9, n.16, pp.4-17. Epub 25-Mar-2024. ISSN 2542-3371. https://doi.org/10.35381/racji.v8i16.3148.
The general objective of the research was to analyze professional liability and its regulation in the Peruvian legal context: Divergences and Perspectives. The method used in the research was based on the qualitative approach, handling the collection and analysis of a documentary-bibliographic typology. The technique applied was the interview; the tool or instrument was the interview guide; which was applied to magistrates of the Judicial District of La Libertad, teachers of the Universities of Trujillo and lawyers specialized in civil law. An analytical-reflective process was generated. The data collection was carried out respecting ethical principles. It is concluded that the perception of the interviewees revealed a significant divergence. While one group considers that this norm establishes a privileged regime of civil liability for professionals, another group interprets it in the opposite way; however, it does not contradict legal theories and doctrine.
Palabras clave : Civil liability; philosophy of action; indemnity.
