The general objective of the research was to legally analyze the effects of the automatic imposition of the penalty of definitive disqualification. It was developed from the quantitative perspective, through the search, collection and critical documentary analysis, bibliographic referential, from a bibliographic design of documentary type, the researcher conducted a research process where the study population was based basically on written documents such as refereed papers, scientific journals, theses, among others, the content analysis of the information collected was considered. The analytical-synthetic method was also used. It is concluded that, after analyzing the results of the research, it can be concluded that the affectation produced by the penalty of disqualification in the principle of equality in the Judicial District of Amazonas, as of 2023 occurs not only because it is a constitutionally protected fundamental right, but also because there should not be disproportionality in the application of penalties.
