The general objective was to legally analyze the tangible matters in mediation of family disputes from the point of view of the best interest of the child, Ecuador. The research was developed from the positivist paradigm and from the quantitative perspective, through the search, collection and critical documentary analysis, bibliographic reference and research studies, in this sense, from a bibliographic design of documentary type, the researcher conducted a research process where the study population was based basically on written documents such as refereed papers, scientific journals, theses, among others. The analytical-synthetic method was also used. It is concluded that the scope of applicability of mediation is quite broad, since there is no pre-established framework that defines, in the legal field, in which types of conflicts should or should not resort to mediation, only the fact of being negotiable or not is mentioned.
