The purpose of the research was to make a legal analysis of the age of criminal responsibility and the protection of children in the Peruvian context. The study adopted a qualitative approach. It was based on the grounded theory research design, whose study scenario was the Prosecutorial Districts of Santa, La Libertad and Tumbes, the method of data analysis was through axial, open and selective coding. According to the purposes of the research and the methodological perspective, in-depth interviews were used as data collection techniques. In addition, the study used documentary review as a technique. It is concluded that it is essential to strengthen the Peruvian juvenile penal system through adequate resources, preventive programs and specialized training to guarantee an effective implementation of the principle of the best interest of the child.
