The general objective of the research was to develop a critical analysis of the deficiencies in collective processes in the Peruvian legal system. The method used was based on inquiry, collection, and critical analysis of documents and bibliographic references. This was based on a meticulous, rigorous, and in-depth exploration of different documentary sources. In this regard, the main techniques applied were content analysis and documentary analysis, supported by specific collection tools, such as analysis sheets, which allowed for the organization and systematization of normative and doctrinal sources. The inductive-deductive method was also used. It was concluded that the regulation of diffuse collective processes in Peru has serious limitations in terms of legitimacy, as it is restricted to certain actors, such as state bodies and special groups, among others, and does not offer incentives for assets of patrimonial value. There are contradictions between the regulations and procedural gaps.
