The aim was to analyze the crime of human trafficking according to Peruvian legislation, considering the elements of the crime; the most used modalities; the aggravating factors, the protected legal good and the criminal policy implemented by the Peruvian State. The same was developed under the hybrid methodological method of critical thematic analysis under the Scoping review model interpreted from documentary analysis, interviews and review of the legislation, managing to identify according to the Peruvian Penal Code and the standards issued; that the recruitment, transfer, reception, retention and submission of a person for the purposes of coercive exploitation or for the exercise of prostitution in Peruvian territory is foreseen and sanctioned in accordance with the provisions of Law 28950, and as indicated in the Protocol of Palermo, trying to protect the dignity of the person as a legal right. Concluding that human trafficking is a crime provided for and regulated by the Peruvian penal code, where the perpetrator who violates human rights can receive a custodial sentence of no less than eight nor more than fifteen years. From the above, new strategies are necessary on the part of the Peruvian State in order to protect and support society in its entirety.
