The general objective of the study is to analyze the current jurisprudential trend on the participation of the injured party in the immediate process in Peru. Regarding the methodology used, this study is characterized by its quantitative approach and its application of a hypothetico-deductive method of a basic nature. Furthermore, it is classified as a study with an explanatory level and follows a non-experimental cross-sectional research design. Regarding the study population, it is made up of 34 lawyers specialized in Constitutional Law from the district of Puno; to which a questionnaire (Likert Scale) was applied for data extraction. Results: 52.9% of lawyers point out that the influence of the injured party balances the decision-making power and can contribute to greater equity in determining the sentence, that is, greater participation of the injured party in the immediate process is required. Conclusion: in the Peruvian legal context, an unfavorable jurisprudential trend is observed that hinders the active participation of the injured party during the immediate process. This tendency is characterized by being an obstacle that hinders the active participation of the injured party in the immediate process. In other words, the analysis reveals that judicial decisions and legal interpretation in Peru are acting in a way that limits or prevents the full involvement of the affected person in the immediate process.
