In the crime of Fraud, the victim has been considered an important factor in the consummation of the act, who is said to have a fundamental role, since without his or her erroneous action or contribution the illicit act would not occur, this is what the doctrine has been called “a simple lie”, leaving these facts uncriminalized, sanctioned and investigated by the Public Ministry as the pursuer of the crime. But it is the case that, although there is a position regarding the crime of fraud for its configuration, it is also the case that all illicit conduct must be punished and even a fact or conduct must be criminalized under the assumption of a “simple lie or irrelevant deception”, which today are neither investigated nor punished, causing a society that feels unprotected against events that they consider a criminal offense.
