Abstract

This study addresses the problem of food assistance for children of affinity within blended families in Latin America, analyzed from an optional and supportive perspective. It highlights how the lack of specific legislation in the field of food law for this type of family structure creates a legal imbalance compared to other forms of family organization. The objective of this research was to examine how, in Latin American countries, blended families are formally recognized as a new family configuration. However, there remains a notable absence of clear regulations regarding food law for children of affinity. The methodology used in this study was qualitative, with a basic legal approach, based on theory and thematic analysis of the content. The results of the research outline the urgent need to create legislation that regulates food assistance for children of affinity, establishing regulations that are based on an optional and supportive principle within this type of blended families. This regulatory gap is due to the lack of clear guidelines defining the obligations between stepparents and stepchildren, considering the duty of mutual respect and obedience that characterizes this relationship. In conclusion, it is essential to promote regulatory changes through specific legislation that regulates alimony for children by affinity. This should include the creation of a legal framework that contemplates an optional and joint determination for stepparents, in order to ensure greater protection of these rights.
