Abstract
FLORES GUERRA, Silvia Edith; LUDENA GONZALEZ, Gerardo Francisco and CUEVA QUEZADA, Nilton Isaías. COMMUNITY LAW IN THE ANDEAN COMMUNITY OF NATIONS. Aula Virtual [online]. 2025, vol.6, n.13, e450. Epub July 14, 2025. ISSN 2665-0398. https://doi.org/10.5281/zenodo.15389992.
The main objective of the article was to qualitatively examine Community law in the Andean Community of Nations (CAN), with a particular focus on the decisions and guidelines that affect the Andean Parliament. The methodology employed was a qualitative approach, the methodology was documentary analysis and literature review, focusing exclusively on academic articles obtained from the Scopus database. Web Of Sciencie and SciELO. The search methodology included the use of the Boolean operators OR and AND. We searched in Spanish and English, all of them open access and all of them in the social sciences. The results indicate that the principle of constitutional supremacy establishes that the Constitution is the fundamental and superior norm in a legal system, imposing limits on the powers of the State in order to guarantee the freedom and rights of citizens. It is concluded that EU law is limited due to the lack of harmonization of the norms, interests and values of each state, which directly affects regional integration. It is relevant that the institutions and actors are trained in the legal aspect, for a correct interpretation of Community law both in the Andean Parliament and in the Andean Community of Nations.
