The resolution of conflicts in co-ownership, particularly in situations related to adverse possession, requires the effective implementation of mediation as an alternative to traditional litigation. This article aims to propose a conceptual legal framework that promotes and regulates mediation and alternative dispute resolution in this context, considering the practical and legal aspects that facilitate its implementation across different jurisdictions. The methodology used follows the PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses) approach, enabling the identification of legal barriers, practical considerations, and regulatory mediation approaches in various jurisdictions. The results reveal significant obstacles to the implementation of mediation, including an inadequate legal framework and a lack of training for mediators. Furthermore, mediation not only reduces the burden on judicial systems but also improves relationships among co-owners by fostering more stable and fair agreements. In conclusion, the study highlights the need for a strong and locally adapted legal framework, as well as adequate mediator training, to maximize the effectiveness of mediation in resolving co-ownership conflicts.
