This research addresses the context of legal restrictions on the political rights of individuals convicted in the first instance, a problem that has profound implications for inclusion and equity in contemporary democracies. It highlights the importance of understanding these impediments not only as legal barriers, but as mechanisms that perpetuate exclusion and affect citizen participation. The article's objective is to evaluate the effectiveness of legal impediments in protecting the political rights of these individuals through a systematic review using the PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses) method. The results reveal that, although there are legal grounds that justify these impediments, such as the need to safeguard the integrity of the electoral system, gaps and contradictions in their application are also identified that limit the rights of certain populations. Consequently, it is concluded that justice systems must be reformed to ensure that the principles of proportionality and equity are prioritized, which has the potential to revitalize public trust and foster an active and critical citizenry. This study underscores the urgency of a broader discussion on the legitimacy and effectiveness of norms regulating political rights, thus contributing to the field of law and human rights.
