Abstract
REYNA CASTRO, Mercedes Elisabeth. THE RIGHT TO IDENTITY: A COMPARATIVE ANALYSIS OF INTERNATIONAL GAMETE DONATION REGULATIONS. Aula Virtual [online]. 2025, vol.6, n.13, e471. Epub July 24, 2025. ISSN 2665-0398. https://doi.org/10.5281/zenodo.15823490.
The rise of assisted reproduction techniques has raised several ethical and legal challenges, particularly regarding gamete donation and the right to identity of those born through these practices. The importance of investigating this topic lies in the need to protect the rights of people conceived through these techniques and ensure they can know their biological origins. This article aims to conduct a systematic review of international legislation on gamete donation, comparing its impact on the right to identity and the perceptions of those born through artificial insemination in different cultural and legal contexts. A systematic review approach is used, applying the PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses) method to assess and synthesize the existing literature in this area. The results indicate significant variations in regulations, ranging from anonymous models to those that guarantee the right to identity, reflecting the influence of cultural and social contexts. This study concludes that it is imperative to reform current legislation toward a model that prioritizes transparency and access to genetic information, recognizing the right to identity as a critical component in the personal development of each individual born through gamete donation. These reforms are not only necessary from a legal perspective but also impact the mental health and emotional well-being of these individuals.
