Abstract

The study focused on analyzing the impact of media exposure on the presumption of innocence of persons subject to criminal proceedings, as well as the incidence of the provisional execution of sentences in the violation of this fundamental principle. To do so, an exhaustive bibliographic review was carried out, using a rigorous search protocol with diverse and combined terms in Spanish, English and Portuguese. Databases such as Dialnet, Redalyc, SciELO, Scopus and Web of Science were consulted, limiting the search to the period 2021-2025, leading to the selection of 25 articles that met the established criteria. The results revealed that Ecuador leads the publications with 32% of the total. After the exhaustive analysis, it was concluded that the media exposure of detainees directly affects the presumption of innocence of the accused, and this impact worsens exponentially when the provisional execution of the sentence is ordered.
