Resumen

VERA MENDEZ, Antonio Enrique. EVALUATION OF ETHICAL ADAPTATION IN DIGITAL NOTARIAL PRACTICE: A SYSTEMATIC STUDY OF NORMATIVE PRACTICES. Aula Virtual [online]. 2025, vol.6, n.13, e539.  Epub 01-Oct-2025. ISSN 2665-0398.  https://doi.org/10.5281/zenodo.17093072.

The digitalization of notarial functions has posed significant challenges that necessitate a critical review of the ethical principles governing this profession. This study focuses on analyzing the existing ethical principles and their appropriate adaptation to new digital tools-an element that has become crucial in the contemporary context. Conducted as a systematic review article using the PRISMA (Preferred Reporting Items for Systematic Reviews and Meta-Analyses) method, this research encompasses a range of recent studies examining the ethical framework of notarial functions across various jurisdictions, highlighting integrity, impartiality, and accountability as fundamental pillars. The findings indicate that, although there is a widespread recognition of the need to adapt these principles to digital realities, the lack of specific training and clear regulations constrains the effectiveness of this adaptation. Moreover, significant gaps were identified in the training of notaries concerning the ethical implications of digital tools. The most relevant conclusion is that this adaptation is not only necessary to safeguard public trust but also to ensure the legitimacy of notarial practice. Based on the results obtained, there is an urgent need to develop regulatory frameworks that support the continuous training of notaries in digital and ethical competencies, thereby ensuring a professional practice that upholds integrity within a transforming environment.
