This article addresses the influence of the family history of socio-affective parents on the implementation of protective measures and compensation decisions in cases of emotional and psychological abuse-a topic of vital importance given the growing concern for child welfare and the effectiveness of protection policies. The main objective of this research is to assess how family dynamics and the prior experiences of parents affect judicial decisions in these contexts, through a systematic analysis of case studies and relevant literature. The methodology used is a systematic review, which allows for the integration and synthesis of findings from previous studies, providing a more comprehensive overview of the relationship between family history and judicial outcomes. The results indicate that a dysfunctional family history, characterized by a lack of cohesion and emotional support, reduces the effectiveness of both protective and compensatory judicial decisions, while perpetuating cycles of vulnerability among children. In conclusion, this study highlights the need to consider family realities in judicial decision-making, suggesting that a more holistic approach can enhance the effectiveness of child protection interventions and offer fairer solutions within the judicial system.
