Abstract

Labor dismissal in Peru presents a series of challenges regarding the protection of human rights, making it a critical field of study. This research identifies and analyzes how a human rights-based perspective can influence a new classification of dismissal within Peruvian labor law. Through a systematic review of recent literature, this study examines research highlighting the need to incorporate principles such as human dignity, equality, and non-discrimination into current labor regulations. This systematic review article applies the PRISMA method (Preferred Reporting Items for Systematic Reviews and Meta-Analyses), employing a qualitative approach to collect, analyze, and synthesize the findings of various authors regarding the application of human rights in the context of labor dismissal. The most significant findings indicate that, although there are existing regulations aimed at recognizing and protecting human rights, their implementation remains inadequate, thereby perpetuating gaps and inequalities in labor protection. In conclusion, the study underscores the urgent need to reform Peruvian labor legislation in line with international human rights standards, which would not only enhance the classification of dismissal but also foster a more equitable and just work environment. These findings pave the way for future research exploring more effective mechanisms for implementing and monitoring fundamental rights in the labor sphere.
