This research addresses a significant legal issue within the field of criminal law: the diversity of interpretations surrounding the theory of the unity of the imputation title and its impact on the resolution of breach of duty cases across different jurisdictions. The importance of this topic lies in the fact that divergent interpretations may undermine the administration of justice and generate legal uncertainty. The main objective of this article is to assess these doctrinal interpretations and their influence on judicial proceedings. A systematic review methodology was used, applying the PRISMA approach (Preferred Reporting Items for Systematic Reviews and Meta-Analyses), through the analysis of various sources and prior studies that examine the theory of imputation from a comparative perspective. The findings reveal that inconsistencies in interpretation not only lead to contradictory rulings but also negatively affect the public perception of justice. The most relevant conclusion of this study emphasizes the need to establish a clear and coherent normative framework that harmonizes the different interpretations of the theory, thereby promoting predictability and fairness in the application of criminal law. This research offers a solid foundation for future legal and academic reforms aimed at improving judicial practice and restoring trust in the legal system.
