Abstract

This study focused on analyzing investigations linked to the administrative sanctioning procedure, considering aspects such as legality, discretion and judicial control. A descriptive analysis of scientific publications, both international and national, collected in the Scopus database from 2019 to 2023 was carried out. Of a total of 1,572 identified investigations, 33 were selected for this study based on their relevance, uniqueness, and relevance. The conclusion of the study highlights that Administrative Sanction Law plays a vital role in the Rule of Law, balancing the protection of collective interests and individual rights. It is essential that administrative sanctions are based on principles of legality and justice. Discretion must be exercised prudently and always under judicial supervision to guarantee equity and avoid arbitrariness.
