Abstract
ROCA ANDAGUA, Rodolfo and RISCO MURILLO, Evelyn Milagros. THE EARLY TERMINATION SENTENCE. Aula Virtual [online]. 2026, vol.7, n.14, e697. Epub Apr 20, 2026. ISSN 2665-0398. https://doi.org/10.5281/zenodo.19599801.
The study aimed to analyze the impact of early termination rulings. A literature review methodology with a grounded theory approach and hermeneutic methods was used, considering articles and documents from relevant public institutions. High-impact databases such as Scopus, SciELO and Google Scholar were used. The results reveal that current regulations do not ensure the full participation of civil actors, as the prosecution prioritizes punishment and efficiency, without considering the real interests of the civil actor. However, early termination seeks to simplify processes and lighten the procedural burden through negotiation between the accused, his defense and the Public Prosecutor's Office. The conclusions highlight the importance of Article 468 of the Code of Criminal Procedure, which explains the scope and consequences of the early termination agreement, as well as its usefulness in establishing voluntary negotiations between the Public Prosecutor's Office and the defendant's lawyer. It is emphasized that early termination sentences constitute an alternative way out with sentencing implications and a criminal record, and that acceptance of the early termination sentence must be spontaneous and voluntary, without coercion or threats.
