The objective of this study is to analyze the current panorama regarding the advances and discussions on issues linked to the impact of fundamental rights when preventive detention is applied in Latin America. The methodology consisted of a review of the bibliographic database of Scopus, Web of Science, Scielo ProQuest, type scoping review. As a result, it is noted that there is an excessive and prolonged procedural use of preventive detention, which contravenes fundamental rights, causing overcrowding problems in inhumane prison conditions, despite the efforts and reforms implemented.
