The objective of this research has been to determine the loss of property in cases of physical and psychological violence during body separation processes in Peru. The methodology used was documentary in nature, for the identification and analysis of the rules and sentences on property losses in the aforementioned cases, and how the law responds to these situations. The comparison of information carried out with the laws, as well as the development of an interview with a trial lawyer and his look at the situations in other countries, revealed that they were contemplated, within a process of separation from the body due to physical-psychological violence, marital losses, it would be possible to simplify such processes, granting the injured party the right that corresponds to them. In this way, the result was that during the process of separation of bodies, marital losses are not contemplated in the Peruvian laws, with which it is possible to conclude the need for the legislation to evolve with respect to the processes of improvement of the regulations. legal, so that cases of marital losses are within the process of separation of the body due to physical-psychological violence, and thus, ensure that the right is effective for the aggrieved party.
