Abstract

This article analyzed the compliance of the Peruvian State in ensuring the right of access to secondary education in rural areas of Peru during the last few years. The qualitative approach, interpretative paradigm, phenomenological design, dogmatic-hermeneutic method, descriptive and exploratory level or scope, documentary analysis technique and the file system instrument were applied. The results reveal a limited state commitment to provide access to secondary education in rural areas, evidenced mainly after the filing of an unconstitutionality action in 2018, which resulted in a constitutional mandate requiring the Ministry of Education (MINEDU) to develop an educational care plan. As a result, provisions and guidelines were developed for the provision of educational service, involving the Regional Education Directorates (DRE), Local Education Management Units (UGEL) and Educational Institutions (IIEE); however, these measures have not achieved effective national coverage, showing gaps in access and educational quality in rural areas.
