Abstract

The Metropolitan Control Agency sanctions violations of Quito's metropolitan regulations. This research critically analyzes the declaration of expiration in its sanctioning procedures, identifying causes and legal consequences. A sample of 94 files from 2022 was examined, referring to constructions in nine areas of the Metropolitan District. It was found that expiration was mainly declared due to delays in issuing the initial act, in substantiating the file, and in the investigation phase. The most notable legal repercussions were the dismissal of proceedings and the revocation of precautionary measures imposed. The findings provide input for proposing regulatory and procedural adjustments aimed at reducing deadlines and avoiding expiration, thereby strengthening legal certainty and the effectiveness of the AMC's sanctioning management. This characterization contributes to optimizing institutional performance and safeguarding the rights of those being administered.
