Abstract

This article compares workplace harassment regulations in the public sector in Ecuador and Colombia. Through a qualitative legal and documentary analysis, twelve criteria were examined, ranging from the constitutional basis to redress mechanisms. The findings reveal that Colombia offers a precise definition, admits isolated acts of high impact, incorporates preventive, punitive, and compensatory phases, and guarantees remedies for reversal and appeal with external control by the Attorney General's Office and the Ministry of Labor. In Ecuador, the regulations are scattered across several instruments, require repeated conduct, and limit proceedings to internal instances without formal mechanisms for challenge or compensation procedures. This comparison highlights the need for Ecuador to adopt international standards, implement review mechanisms, and consolidate a comprehensive reparation process to strengthen protection and impartiality in the treatment of public servants.
