Abstract

This study analyzes the exclusive jurisdiction of the Municipal GAD of Pastaza over land use and its interference in traffic jurisdiction, evaluating its legal effects. The objective is to determine whether the administrative resolutions issued in this area guarantee legal certainty and due process, in accordance with the Constitution and the law. Using an action research methodology, theoretical (analytical-synthetic) and empirical (documentary analysis) methods were employed to compare regulations and administrative acts. The discussion reveals the conflict of jurisdiction with the transit entity Transcomunidad EP. It is concluded that acts contrary to current regulations may violate jurisdictions and affect the rights of public transport operators, proposing to unify criteria to avoid discretion.
