In Ecuador, despite the fact that the Constitution (Art. 57) and international law recognize and guarantee the collective rights of indigenous peoples and communities, in administrative practice there is no evidence of compliance. The scientific problem posed was: How can non-compliance with the constitutional right to direct access to public resources be verified through the establishment of Indigenous Territorial Constituencies as a special government regime for the Amazonian peoples of Ecuador? The overall objective was to assess the level of non-compliance with these collective rights. Documentary analysis was used as the main method, supplemented by interviews with members of nationalities involved in administrative processes. The results reflect limitations in the efficiency, compliance, and respect for these rights, with consequences that deepen historical inequalities. The research seeks to propose alternatives that contribute to the vindication of collective rights and promote autonomous management of indigenous territories.
