Abstract

Every nation must guarantee its citizens the right to due process as a means of achieving legal certainty. This article aims to analyze precisely the violation of the right to due process when an appeal is denied in a protective action on the grounds that the plaintiff could challenge an act of the Civil Registry (RC) through administrative or judicial channels. The analytical-synthetic method was used, as it allowed for the use of different sources of information, such as doctrinal analysis and regulations, thus clearly determining that the result achieved evidences the violation of this right. Thus, it can be deduced that in the public service provided by the Civil Registry of the City of Guayaquil in the case studied, there is a violation of the right to identity due to the duplication of identity card information.
