Abstract

This article analyzes the jurisdictional guarantee of protective action in Ecuador. The objective is to develop a critical legal analysis of evidence in protective action, in order to contribute to respect for evidentiary value in the Quevedo canton in 2023. This is a qualitative research study with an analysis of the literature related to the subject and an assessment of evidence in this context. Interviews were conducted with legal professionals and judges in the canton of Quevedo to gather their perceptions on the subject. The result was an analysis of the principles surrounding the jurisdictional guarantee of protective action and the importance of the constitutional right to evidence in this context. It was concluded that a deeper understanding of the challenges facing protective action and improving the effectiveness of this jurisdictional guarantee is necessary.
