Abstract

The research was conducted in the context of the constitutional recognition of nature as a subject of rights and environmental consultation as a mechanism for citizen participation. The main objective was to determine the effects of environmental consultation in the province of Santo Domingo de los Tsáchilas during the period 2020-2022, identifying cases in which the rights of nature may have been violated. Analytical-synthetic, inductive, and documentary analysis methods were applied, complemented by interviews with professionals and a review of information from state entities. The results showed that only a minority of processes complied with the principle of maximum publicity and that confusion persisted between environmental consultation and free, prior, and informed consultation. It was concluded that the problem arose both from the authorities' failure to comply with regulations and from the absence of effective mechanisms for representing nature.
